1. Scope of application

1.1 These General Terms and Conditions apply to all contracts between E.A.S.D. Event Actioning Studio (hereinafter “E.A.S.D.”) and its customers in the field of event photography, videography, and related services (event support, setup and teardown assistance, and organizational support services).

1.2 Any deviating terms and conditions of the customer shall only apply if they have been accepted in writing.

2. Conclusion of Contract

2.1 Offers from E.A.S.D. are subject to change without notice, unless expressly stated otherwise.

2.2 The contract is concluded upon written acceptance of an offer (e.g., via email) or upon written confirmation.

2.3 E.A.S.D. is entitled to reject orders without providing reasons.

2.4 E.A.S.D. may engage third parties to fulfill the order.

3. Services

3.1 The subject matter of the contract is the service described in the respective offer.

3.2 The exact scope of services is set forth in the offer (e.g., duration, deliverables, number of images/videos, additional services).

3.3 E.A.S.D. shall perform the services with professional care, but without guaranteeing a specific subjective result (e.g., artistic evaluation of photos/videos).

3.4 For photo and video projects, the number of final images delivered may vary depending on the event, duration, and situation.

4. Mediation services

4.1 When assisting with catering or location searches, E.A.S.D. Event Actioning Studio acts solely in a supporting and mediating capacity.

4.2 Contracts between customers and third-party providers are concluded directly between those parties.

4.3 No liability is assumed for the services, prices, or failures of third-party providers..

5. Customer’s Obligations to Cooperate

5.1 The Customer shall ensure that all information necessary for the execution of the event is provided in a timely manner.

5.2 The Customer is responsible for obtaining any necessary authorizations, permits, and rights (e.g., venue approvals, photo/video permits for events).

5.3 The customer shall inform E.A.S.D. of any relevant safety regulations, access restrictions, or special conditions at the event venue.

6. Prices and Payment

6.1 The prices agreed upon in the quotation in Swiss Francs (CHF) shall apply.

6.2 Unless otherwise agreed, invoices are payable within 14 days without deduction.

6.3 E.A.S.D. may require advance payments (deposits).

6.4 In the event of late payment, reminder fees and late payment interest may be charged.

7. Service Provision and Delivery Times

7.1 Delivery times are approximate unless explicitly agreed to be binding.

7.2 Typical delivery times:

- Photography: Preview of 15 photos within 24 hours, final delivery within 3 days
- Videography: Delivery within 2–5 days

7.3 Delays due to force majeure or unforeseeable circumstances entitle E.A.S.D. to reasonably adjust the delivery time.

8. Cancellation

8.1 The following fees apply in the event of cancellation by the customer:


- 3 to 10 days prior to the scheduled date: 25% of the agreed fee.
- Less than 3 days prior to the scheduled date: 50% of the agreed fee.

8.2 Any costs already incurred (e.g., preparation, reservations, third-party services) will be billed additionally.

8.3 Cancellations must be made in writing via email.

9. Force Majeure

9.1 In the event of circumstances beyond the control of the parties (e.g., illness, accident, weather, government orders, natural disasters), liability for resulting damages is waived.

9.2 Services already rendered and costs already incurred may be billed.

10. Rights of Use / Copyright

10.1 All copyrights to photos and videos remain with E.A.S.D.

10.2 Upon full payment, the customer receives a non-exclusive right to use the delivered photos and videos for the purposes agreed upon.

11. Use of Reference Material

11.1 E.A.S.D. may use created photographs, videos, and other project materials for portfolio, website, social media, and marketing purposes.

11.2 The Client may object to such use in writing before the start of the project.

11.3 In exceptional circumstances, the Client may request the removal of previously published material after publication. E.A.S.D. will review such requests in good faith and, where reasonable and technically feasible, remove the material within an appropriate timeframe.

12. Liability

12.1 E.A.S.D. is liable only for direct damages caused by willful misconduct or severe negligence.

12.2 Liability for indirect damages, consequential damages, or lost profits is excluded to the extent permitted by law.

12.3 Liability is limited to a maximum of the order value to the extent permitted by law.

12.4 No liability exists for technical failures, data loss, weather conditions, or third-party services.

13. Subsistence during longer assignments

13.1 For assignments lasting more than 6 hours, the customer shall provide appropriate meals and non-alcoholic beverages.

14. Final Provisions

14.2 The place of jurisdiction is, to the extent permitted by law, the domicile of the owner of E.A.S.D.

14.3 Should individual provisions be invalid, the remainder of the Terms and Conditions remain valid.

14.4 E.A.S.D. reserves the right to amend these Terms and Conditions at any time. The version valid at the time the contract is concluded shall apply.
